How to choose The right witness for your WILL: Expert tips and advise



So you have done all the hard work and collected all data decided on how your estate will be divided. Well, there is one more important step, you have to choose a witness for your will. In India, a will must be signed in the presence of two witnesses who are not beneficiaries of the will. The witnesses must also sign the will to verify that they were present when the testator (the person writing the will) signed it and that they believe the testator was of sound mind and understood what they were doing.


When choosing witnesses for your will, I suggest you keep the following in mind:




Choose someone who is trustworthy: It's important to choose witnesses who are reliable and trustworthy. They should be people you trust to follow through on their responsibilities and who will be available to testify if required.


Choose someone who is not a beneficiary: It's important to choose witnesses who are not beneficiaries of your will, as this could create a conflict of interest. The witnesses should have no stake in the distribution of your assets.


Choose someone who is over 18 years old: In India, witnesses must be at least 18 years old to sign a will. Make sure you choose people who meet this requirement.


Choose someone who is not related to you: While it's not mandatory for witnesses to be unrelated to the testator, it's a good practice to choose people who are not related to you. This helps to avoid any potential accusations of undue influence or coercion.


Choose someone who is easily reachable: It's important to choose witnesses who will be easily reachable in case they need to testify in court. This could be someone who lives nearby or who has a reliable means of communication.


By keeping these factors in mind, you can choose witnesses who will be able to sign your will and attest to its validity. Remember that witnesses play a crucial role in the execution of a will, so it's important to choose them carefully.
